Fanara Fine Arts Terms of Service

Last updated October 20, 2026

These Terms of Service ("Terms") govern use of fanarafinearts.com and purchases made directly from Fanara Fine Arts LLC ("Fanara Fine Arts," "we," "us," or "our"), based in Baton Rouge, Louisiana, United States. They cover our original artwork, commissioned artwork, and studio tools, including the Fanara Fine Arts 4-Zone Oil Paint Brush Cleaner.

Please review these Terms before using the website or placing an order. By placing an order or otherwise affirmatively accepting these Terms, you agree to them. Our Privacy Policy explains how personal information is handled; accepting these Terms is not consent to optional marketing or tracking.

1 Eligibility and appropriate use

You must be at least 18 and legally able to enter a contract to place an order. A parent or legal guardian may purchase on behalf of a minor. Provide accurate contact, delivery, and payment information, and use only payment methods you are authorized to use.

You may not use the website for fraud, unlawful activity, malicious software, unauthorized access, infringement of another person's rights, or interference with the website's operation. If you create an account, protect your login information and notify us promptly of suspected unauthorized access.

2 Product information and availability

We aim to describe products accurately. Screen settings and lighting can affect how colors and finishes appear. Original artwork and hand-finished products may have normal variations consistent with their descriptions. Framing, dimensions, materials, and included components are as stated in the applicable listing or written agreement. These statements do not excuse a material mismatch or a defective product.

Original paintings are generally one-of-a-kind and availability may change. Photographs may include brushes, solvent, easels, frames, or other props that are not included unless expressly listed. Cleaner performance depends on factors such as brush type, paint, solvent condition, and technique; demonstrations do not promise an identical result in every situation.

3 Prices payments and orders

Prices are in U.S. dollars unless another currency is expressly displayed. Applicable taxes and any delivery charges are shown before you complete your purchase. Prices and offers may change for future purchases; changes do not alter an accepted order.

Payment is collected through the methods offered at checkout. An automated receipt confirms that we received your order. We may contact you or cancel and refund an order if an item is unavailable, payment cannot be verified, fraud is reasonably suspected, or there is a material listing or pricing error. We will not charge a corrected price without your agreement. This provision is subject to applicable consumer law.

If you need to change or cancel an order, contact us promptly. We will try to accommodate the request, but changes may not be possible after shipment or after agreed commission work has begun.

4 Shipping and delivery

Available delivery locations, costs, and timing are stated in the relevant listing, checkout, shipping policy, or commission agreement. For the cleaner, consult the Shipping & Returns page linked below for eligible destinations, included standard shipping, and processing times. Other products may have different arrangements.

Delivery estimates are not guaranteed arrival dates unless expressly identified as a guarantee. If we cannot ship within the promised period, we will provide the delay notice, cancellation option, and refund required by law. Contact us about missing or damaged deliveries so we can investigate and arrange an appropriate resolution. We do not treat carrier handoff alone as eliminating our responsibility to address a delivery problem.

5 Returns refunds and product problems

For the 4-Zone Oil Paint Brush Cleaner, the Shipping & Returns policy presented when you ordered forms part of these Terms:
https://www.fanarafinearts.com/brush-cleaner-shipping-returns

That policy provides a 30-day return request window measured from delivery and allows normal instructed use. Return all included product components. Preference returns are at the customer's postage expense, with no restocking charge. After receipt and inspection, we refund the purchase price and applicable sales tax. Misuse, unauthorized alterations, and prohibited liquids are excluded from this voluntary return offer. Confirmed transit damage or manufacturing defects qualify for an appropriate replacement or refund, with necessary return postage paid by us.

Contact us before shipping a return. Never send mineral spirits, other free liquid, or solvent-soaked materials. Follow the preparation and packing instructions we provide. A refund is normally issued to the original payment method; your payment provider controls when it appears in your account.

Artwork and commission return or cancellation terms are those specifically disclosed before purchase in the listing or a separate written agreement. The cleaner's voluntary return offer does not automatically apply to artwork. No additional final-sale restriction or nonrefundable commission deposit is created by these Terms alone.

Voluntary return deadlines do not eliminate rights or remedies you may have for defective, damaged, or misdescribed goods under applicable law.

6 Brush cleaner use and care

The cleaner is intended for removing wet oil paint during studio use with artist-grade odorless mineral spirits only. Solvent and painting brushes are not included unless a listing expressly states otherwise. Follow the supplied instructions, our Setup & Care guide, and the solvent and paint manufacturers' safety directions.

Use adequate ventilation and keep solvent and contaminated materials away from ignition sources, children, and pets. Keep the cleaner upright on a stable surface. The lid is not a liquid-tight transport seal. Empty the cleaner before transport and dispose of solvent and paint waste in accordance with applicable requirements; never pour them into a drain.

Select the cleaning action appropriate to your brush and use controlled pressure. Stop use if a component loosens, the deck becomes unstable, an edge is damaged, or the product otherwise appears unsafe. Contact us for assistance. Product-use requirements do not waive any responsibility or remedy that applicable law places on us.

7 Artwork ownership and commissions

Purchasing an original painting transfers ownership of that physical artwork after full payment. Unless separately agreed in writing, the artist retains copyright and reproduction rights. Ownership of the physical piece does not authorize making or selling prints, merchandise, or other commercial reproductions. Rights and exceptions provided by copyright law remain unaffected.

Commission details, including subject, size, price, payment schedule, revisions, timing, cancellation, delivery, and any reproduction license, must be agreed separately in writing. A commission inquiry by itself does not reserve a place in the schedule or create an obligation to complete a project.

Provide reference photographs and other materials only if you have the necessary rights and permissions, including permission from the photographer where required. You allow us to use those materials to evaluate and perform the requested commission. Submitting them does not automatically authorize publication of private reference photographs or your personal information.

8 Website content and customer reviews

Website artwork, photographs, videos, written content, branding, and designs belong to Fanara Fine Arts, Philip Fanara, or their respective owners. You may view the site, share links, and keep copies of instructions for personal use. Commercial reproduction or reuse requires permission unless authorized by law. Report suspected infringement to philip@fanarafinearts.com.

If you submit a review for publication, you grant us a nonexclusive, royalty-free permission to display it with the display name you provide on our website and to use service providers to host it. You retain ownership of your content. Reviews should reflect your honest experience and must not disclose another person's private information, contain unlawful material, or infringe others' rights.

We may remove spam, unlawful content, or content that violates these rules. We do not prohibit truthful negative reviews or remove reviews merely because they are unfavorable. These Terms do not require you to transfer ownership of a review.

9 Website availability and product warranties

The website may be interrupted or contain errors. To the extent permitted by law, the website and its general informational content are provided as available, without a promise of uninterrupted or error-free operation. Third-party websites and services linked from our site have their own terms and practices.

This website availability provision does not make purchased products an "as is" sale. Product descriptions, any express written warranty or guarantee, and applicable legal warranties remain in effect. These Terms do not establish a new fixed warranty period or waive Louisiana rights relating to redhibitory defects, meaning defects that can justify rescission or a price reduction under applicable law.

10 Limits of liability

To the extent permitted by applicable law, we are not responsible for indirect or consequential business losses, such as lost profits or business interruption, arising from use of the website or products.

This limitation does not apply to personal injury or death, damage to tangible property caused by a defective product, fraud, intentional or gross fault, express product commitments, applicable warranty remedies, or any responsibility that the law does not allow us to limit. Nothing in these Terms reduces a mandatory consumer right or remedy.

11 Governing law and disputes

Louisiana law and applicable federal law govern these Terms, subject to any mandatory consumer protections that apply in your place of residence. Please contact philip@fanarafinearts.com about a dispute so we can try to resolve it. Contacting us first is encouraged, not a condition that removes your right to pursue a lawful remedy or payment dispute.

Unless mandatory law requires otherwise, disputes may be brought in courts with appropriate jurisdiction in East Baton Rouge Parish, Louisiana. Nothing here prevents an eligible small-claims action or a claim in another forum required by applicable law. These Terms do not require arbitration or waive class-action rights.

12 Changes and other terms

We may update these Terms for future transactions by posting a revised version with an updated date. Changes do not retroactively alter an existing order or dispute. We will provide additional notice or request acceptance when required.

Specific product terms disclosed before purchase or a separate written commission agreement control over a conflicting general provision here. If one provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive it for later occasions.
